This End User License Agreement ("Agreement") governs your use of Publish Services Auditor ("PSA"), software developed and distributed by DeVilbiss Media.
By purchasing, downloading, installing, activating, or using PSA, you agree to the terms of this Agreement.
1. License Grant
Purchase of Publish Services Auditor grants you a perpetual, non-exclusive, non-transferable license to use PSA for your own personal or business purposes.
Your PSA license does not expire and does not require a subscription.
The license permits activation and use of PSA on up to two computers at a time for use by the same license holder. The two-computer allowance is intended to accommodate situations such as use on a desktop and laptop, multiple personal workstations, or replacement of one computer with another. It does not grant separate licenses to multiple individuals.
You are purchasing a license to use PSA. Ownership of the software, its source code, and associated intellectual property is not transferred to you.
2. License Keys and Activation
A valid license key is required to activate PSA.
Your license key is for your use and may not be sold, shared, published, transferred, sublicensed, or distributed to another person or organization.
Activation limits may be enforced electronically. If you replace a computer or otherwise need to transfer an activation, available deactivation or license-management procedures may be used to free an existing activation.
Internet access may be required for initial activation, license validation, deactivation, or other license-management functions.
3. Updates to Publish Services Auditor
Your PSA license includes updates to the existing Publish Services Auditor product at no additional license cost.
These updates may include:
- Bug fixes and reliability improvements
- Performance improvements
- User-interface refinements
- Compatibility updates
- Workflow improvements
- Enhancements or additions that support, extend, streamline, or improve PSA's existing core functionality
There is no requirement to purchase a new PSA license solely because the version number changes or PSA receives updates, improvements, or refinements to its existing functionality.
The availability, timing, and frequency of updates are determined by DeVilbiss Media.
4. New or Separate Products
DeVilbiss Media may develop future software that expands substantially beyond the core purpose and functionality of Publish Services Auditor.
Software that introduces substantial functionality outside PSA's existing core purpose may be released as a new or separate product and may require a separate purchase or license.
A perpetual PSA license does not automatically grant a license to future products developed by DeVilbiss Media simply because those products incorporate, build upon, integrate with, or are related to functionality originally found in PSA.
Your existing PSA license will remain valid for Publish Services Auditor regardless of the introduction of a separate or expanded product.
5. Restrictions
You may not:
- Redistribute, resell, sublicense, rent, lease, or share PSA or your license key.
- Make PSA or your license key available for use by another person beyond the rights granted under this Agreement.
- Use the two-computer activation allowance to provide separate licenses to multiple individuals.
- Copy or distribute PSA except as reasonably necessary for your own installation or backup.
- Modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of PSA except where such restrictions are prohibited by applicable law.
- Remove or alter copyright, licensing, attribution, trademark, or ownership notices contained in the software or accompanying materials.
6. Adobe Lightroom Classic
Publish Services Auditor is designed for use with Adobe Lightroom Classic.
PSA is an independent third-party product and is not affiliated with, endorsed by, sponsored by, or otherwise officially associated with Adobe Inc.
Adobe and Lightroom Classic are trademarks or registered trademarks of Adobe Inc.
Changes made by Adobe to Lightroom Classic, the Lightroom Classic SDK, Publish Services, or related technologies may affect PSA's operation or compatibility.
7. Software Operation and User Responsibility
PSA is designed to inspect information provided by Adobe Lightroom Classic Publish Services and assist users in identifying and locating photos requiring publishing-related attention.
PSA does not replace Lightroom Classic's publishing functionality and does not independently publish, republish, modify, or remove photographs from Publish Services.
You remain responsible for reviewing PSA's results and determining what actions should be performed within Lightroom Classic.
You are responsible for maintaining appropriate backups of your Lightroom catalogs, photographs, configuration files, and other important data.
8. Availability, Compatibility, and Continued Development
DeVilbiss Media may provide updates intended to maintain or improve compatibility with supported versions of Adobe Lightroom Classic.
However, continued compatibility with every future version of Lightroom Classic, every operating system, computer configuration, third-party Publish Service, or other third-party software or service cannot be guaranteed.
The perpetual nature of your PSA license grants you continued rights to use the PSA software covered by that license. It does not guarantee perpetual development, technical support, compatibility updates, availability of online services, or the release of future updates.
Discontinuation of future development or support does not convert the perpetual license into a subscription or otherwise terminate your right to continue using a compatible version of PSA, subject to this Agreement.
9. Third-Party Services and Publish Services
PSA may interact with information made available through Lightroom Classic and Publish Services created by Adobe or third parties.
DeVilbiss Media does not control third-party Publish Services, websites, APIs, software, or services and cannot guarantee their continued availability, behavior, or compatibility with PSA.
Changes to third-party products or services may affect information available to PSA or PSA's ability to analyze that information.
10. Disclaimer of Warranty
To the fullest extent permitted by applicable law, Publish Services Auditor is provided "as is" and "as available", without warranties of any kind, express or implied.
DeVilbiss Media does not warrant that PSA will be error-free, uninterrupted, completely accurate, or compatible with every hardware, software, operating-system, Lightroom Classic, Publish Service, or third-party configuration.
Use of PSA is at your own discretion and risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
To the fullest extent permitted by applicable law, DeVilbiss Media will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from the installation, activation, use, inability to use, or performance of PSA.
This includes, without limitation, loss of photographs, data, catalogs, publishing information, business, revenue, profits, or productivity.
You are responsible for maintaining appropriate backups of important data before using PSA or making changes within Lightroom Classic.
To the fullest extent permitted by applicable law, DeVilbiss Media's total liability for any claim arising from or relating to PSA will not exceed the amount originally paid for the PSA license giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
12. Termination
Your PSA license remains valid indefinitely unless terminated due to a material violation of this Agreement.
If you materially violate these terms, DeVilbiss Media may terminate your license and associated activation rights.
Upon termination, you must discontinue use of PSA and remove copies of the software under your control.
Termination resulting from a violation of this Agreement does not affect any rights or remedies available to DeVilbiss Media under applicable law.
13. Changes to This Agreement
DeVilbiss Media may revise these terms for future purchases, products, or releases.
Changes to this Agreement will not revoke the perpetual PSA license previously granted to you except where necessary to address misuse, fraud, violation of these terms, or requirements of applicable law.
The version of this Agreement provided with your purchased version of PSA should be retained with your software records.
14. Ownership and Intellectual Property
Publish Services Auditor, including its software, design, code, documentation, branding, and other original materials, is owned by DeVilbiss Media and is protected by applicable copyright and intellectual-property laws.
Except for the limited license expressly granted by this Agreement, no ownership rights or other intellectual-property rights are transferred to you.
15. Entire Agreement
This Agreement constitutes the terms governing your software license to Publish Services Auditor and supersedes prior statements regarding the scope of that software license to the extent those statements conflict with this Agreement.
Additional terms presented by the payment processor, marketplace, or distribution platform may separately apply to the purchase transaction or use of those services.
16. Severability
If any provision of this Agreement is determined to be invalid or unenforceable under applicable law, the remaining provisions will continue in effect to the fullest extent permitted by law.
